KQRS’ “Harley Davidson Two For the Road 2-Fers Giveaway” Contest Official Rules 2.0 –Gift Card Restrictions

A complete copy of these rules can be obtained at the offices of radio station KQRS-FM (“Station”), owned and operated by Minneapolis Radio Assets, LLC located at 2000 SE Elm Street, Minneapolis, MN 55414, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address.

The Station will conduct the KQRS “Harley-Davidson Two For the Road 2-Fers GiveawayContest (the “Contest”) substantially as described in these rules, and by participating, each participant agrees as follows:

 

  1. No purchase is necessary to enter or win. A purchase will not increase your chance of winning.   Void where prohibited.  All federal, state, and local regulations apply.

Eligibility.  This Contest is open only to legal U.S. residents, age eighteen (18) or older at the time of entry with a valid Social Security number and who reside in the Station’s Designated Market Area (“DMA”) as defined by Nielsen Audio, who have not won a prize from the Station in the last 60 days, or a prize valued at $500 or more in the last 90 days and whose immediate family members or household members have not won a prize from the Station in the last 60 days or a prize valued at $500 or more in the last 90 days.   Void where prohibited by law.  Employees of Cumulus Media, its parent company, affiliates, related entities and subsidiaries, promotional sponsors, prize providers, advertising agencies, other radio stations serving the Station’s DMA, and the immediate family members and household members of all such employees are not eligible to participate. The term “immediate family members” includes spouses, parents and step-parents, siblings and step-siblings, and children and stepchildren.  The term “household members” refers to people who share the same residence at least three (3) months out of the year. The Contest is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Station’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.  Only one (1) Qualifier per household and/or immediate family. 

  1. Contest Period. The Contest will begin at 10:00 a.m. CST on March 28, 2019 and will run through 7:00 p.m., CST on April 24, 2019 (the “Contest Period”).  The Station’s computer is the official time keeping device for this Contest.
  2. How to Enter. To Enter:

(i)  On-airDuring the Contest Period, listeners must be listening for “2-Fers” (two {2} songs by the same artist to be played in a row), which will be their cue to call.  The cues to call will occur once during each of the following set times on the following dates and are all listed in CST zone:

On Thursday, March 28, 2019:  10:00 AM hour, 1:00 PM hour, 4:00 PM hour and 6:00 PM hour

On Friday, March 29, 2019:  11:00 AM hour, 2:00 PM hour, 5:00 PM hour and 7:00 PM hour

On Saturday, March 30:  10:00 AM hour, 12:00 PM hour, 3:00 PM hour and 6:00 PM hour

On Sunday, March 31, 2019:  10:00 AM hour, 1:00 PM hour, 4:00 PM hour and 6:00 PM hour

On Monday, April 1, 2019:  11:00 AM hour, 2:00 PM hour, 5:00 PM hour and 7:00 PM hour

On Tuesday, April 2, 2019:  10:00 AM hour, 12:00 PM hour, 3:00 PM hour and 6:00 PM hour

On Wednesday, April 3, 2019:  10:00 AM hour, 1:00 PM hour, 4:00 PM hour and 6:00 PM hour

When they hear the cue to call (two {2} songs by the same artist to be played back to back), then they must be the twenty-fifth (25th) caller (as determined by the Station in its sole discretion) to 651-989-7625 or 651-989-7655 during the Contest Period to be qualified to win a Daily Prize during the Contest Period and be entered to win the Grand Prize.  Each phone number will be allowed to call once per day/per person for a total of (up to) one (1) entry per day, per phone number.

The Station will award a total of one hundred and twelve (112) Qualifying Prize Winners on-air during the Contest Period.

Time Delay Between Over-the-Air Analog Signal and Internet Broadcast: Due to the time delay that exists between the Station’s analog over-the-air signal and the Station’s online webcast, listeners who listen to the Station online may hear the cue to call later than listeners listening to the Station’s analog over-the-air signal. As a result, the odds of an online listener entering this Contest on-air may be diminished.  Any attempt by any participant to submit more than one (1) entry by using multiple/different telephone phone numbers, identities, or any other methods will void that participant from further participation in the Contest.

 

(ii)  Remote BroadcastAttend a remote broadcast conducted by that Station and complete an entry form.  Limit one (1) entry per person per remote broadcast.  All entries must be received by the deadline stated at the remote broadcast.

 

Broadcast #1 will take place at Twin Cities Harley-Davidson, located at 10770 165th Street West in Lakeville, MN on April 6, 2019 from 12:00 PM to 2:00 PM CST.

Broadcast #2 will take place at Twin Cities Harley-Davidson, located at 1355 98th Avenue NE in Blaine, MN on April 20, 2019 from 12:00 PM to 2:00 PM CST.

The Station will award a total of two (2) Qualifying Prizes at Remote Broadcasts (one {1} Qualifying Prize per Remote Broadcast during the Contest Period.

 

The Station will randomly draw one (1) entrant from a pool of all valid entries received at Broadcast #1 on April 6 and one (1) entrant from a pool of all valid entries received at Broadcast #2.  These two (2) entrants will be eligible to win a Qualifying Prize.  Incomplete and/or illegible entries, as determined in Station’s sole discretion, will be deemed not entered for purposes of this Contest.

  1. Qualifying Prize Winner Selection. The twenty-fifth (25th)  person to call, as described above, at set times from March 28, 2019 through the set times on April 24, 2019, will be eligible to win a Qualifying Prize (subject to verification of eligibility and compliance with the terms of these rules) and be entered to win the Grand Prize.  In addition, one (1) entry from the Remote Broadcast on April 6, 2019 and one (1) entry from the Remote Broadcast on April 20, 2019 will be randomly drawn from all valid Remote Broadcast entries and will be eligible to win a Qualifying Prize (subject to verification of eligibility and compliance with the terms of these rules) and be entered to win the Grand Prize, subject to verification of eligibility and compliance with these contest rules.    The Station will award a total of one hundred and twelve (112) Qualifying Prizes away on-air and an additional one (1) Qualifying Prize at EACH Remote Broadcast for a total of two (2) Qualifying Prizes awarded at Remote Broadcasts; this will make a total of (up to) one hundred and fourteen (114) total Qualifying Prizes awarded during this Contest Period.  The (up to) one hundred and twelve (112) On-Air Qualifying Prize Winners will be notified at the time of qualifying by the on-air talent over the phone and given details regarding the finale event.  The two (2) Remote Broadcast Qualifying Prize Winners will be contacted by end of day on Monday, April 22, 2019, using the telephone number provided with the entry and may be awarded the prize (subject to verification of eligibility and compliance with the terms of these rules). Station’s decisions as to the administration and operation of the Contest and the selection of the potential winner are final and binding in all matters related to the Contest. Failure to respond to the initial verification contact within three (3) days of notification will result in disqualification.
  2. Grand Prize Winner Selection.  TO BE ELIGIBLE TO WIN THE GRAND PRIZE, ALL (up to) one hundred and fourteen (114) QUALIFIERS MUST ATTEND THE FINALE EVENT FROM 1:00 to 4:00 PM CST at the Twin Cities Harley-Davidson store in Blaine, MN,  located at 1355 98th Avenue NE, on Saturday, April 27, 2019.  Any and all Qualifiers who do not attend will forfeit their chance to win the Grand Prize.  NO PROXIES WILL BE ALLOWED FOR ANY REASON. You must check-in, starting at 11:00 AM CST and no later than 12:00 PM CST, presenting a current, government issued photo ID and remain present throughout the duration of the Finale Event.  Failure to check-in by the deadline and/or failure to bring a current, valid government issued photo ID will lead to immediate disqualification and the qualifier will no longer be eligible to win the Grand Prize.  Leaving the premises and/or not presenting yourself within thirty (30) seconds of his/her name being called will deem the person no longer present for purposes of this Contest and at that time the person who is no longer present is immediately disqualified and not eligible to win the Grand Prize.

In Round 1 of the finale event on April 27, 2019, the up to one hundred and fourteen (114) Qualifying Prize Winners who are present and checked-in will be issued a ticket with their name on it.  The Station will then put those up to one hundred and fourteen (114) tickets in a bucket and randomly draw fifty (50) tickets out at approximately 1:00 PM CST.  The fifty (50) people who had their tickets pulled will move on to Round 2.   In Round 2, the fifty (50) tickets will all go back into the bucket and twenty-five (25) tickets will then be drawn out at approximately 2:00 PM CST.  The twenty-five (25) Qualifiers with their name drawn will move on to Round 3.  In Round 3, the same twenty-five (25) tickets that were drawn in Round 2 will again be placed in a random drawing with ten (10) tickets drawn at random from them at approximately 2:30 PM CST.  Those ten (10) Qualifiers whose names were drawn will move on to Round 4.  In Round 4, the same ten (10) tickets drawn in Round 3 will go into another random drawing.  This time, five (5) tickets will be drawn out of them at approximately 3:00 PM CST.  The Qualifiers whose five (5) names were drawn will move on to Round 5.  In Round 5, occurring at approximately 3:30 PM CST, two (2) tickets will be drawn from the remaining five (5) tickets.  These two (2) Qualifiers will move on to the final round, Round 6, where one more random drawing will take place and one (1) winning ticket will be drawn at approximately 3:55 PM CST.  The finalist holding this matching ticket will become the Grand Prize Winner and may be awarded the Grand Prize, subject to verification of eligibility and compliance with these Contest Rules.  Station’s decisions as to the administration and operation of the Contest and the selection of the potential winner are final and binding in all matters related to the Contest. Failure to respond to the initial verification contact within three (3) days of notification will result in disqualification.

  1. Verification of Potential Winner. THE ELIGIBILITY OF ALL POTENTIAL CONTEST WINNERS IS SUBJECT TO VERIFICATION BY STATION WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. The potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner may be notified by email and/or telephone call after the date of random drawing and/or winner determination. The potential winner will be required to sign and return to Station, within three (3) days of the date notice is sent, an affidavit of eligibility and a liability/publicity release (except where prohibited) in order to claim his/her prize, if applicable.  A winner who returns the affidavit of eligibility and liability/publicity release will be deemed to have accepted the contest prize and thereafter will not be permitted to rescind their acceptance of the prize and/or return the prize. If a potential winner cannot be contacted, fails to sign and return the affidavit of eligibility and/or the liability/publicity release within the required time period (if applicable), or if the prize or prize notification is returned as undeliverable, potential winner forfeits prize. In the event that the potential winner of a prize is disqualified for any reason, Station may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.    
  2. Prizes. A total of up to one hundred and fourteen (114) Qualifying Prizes and one (1) Grand Prize will be awarded in this Contest during the Contest Period.  The Qualifying Prize Winners (“Qualifying Prize Winner”) will each receive a $25 Harley-Davidson gift card valid at one (1) specific Harley-Davidson store (either the Lakeville or Blaine, MN locations), to be determined in the Station’s sole discretion and a $25 Bobby & Steve’s Auto World gift card.  Neither the Harley-Davidson nor the Bobby & Steve’s gift cards may be redeemed for cash; furthermore, the Bobby & Steve’s Auto World gift cards cannot be used to purchase MN Lottery Tickets with.   The Approximate Retail Value (“ARV”) of each Qualifying Prize is fifty dollars ($50).  The Grand Prize winner (“Grand Prize winner”) will receive two (2) 2019 Harley-Davidson Iron XL1200 NS motorcycles.  The Approximate Retail Value (“ARV”) of the Grand Prize is nineteen thousand and nine hundred and ninety eight dollars ($19,998).  Winner can choose to receive the cash value of the bikes in the amount of $14,000 if they prefer the payout instead of receiving two (2) bikes as the Grand Prize.  The cash payout of $14,000 will be in the form of a check to be issued by Twin Cities Harley-Davidson within sixty (60) days of winning the Grand Prize. GRAND PRIZE WINNER MUST EITHER TAKE TWO (2) BIKES OR CASH PAYOUTAND MAY NOT ACCEPT PORTIONS OF THE GRAND PRIZE (i.e. one (1) bike).  Grand Prize Winner must also decide which option they prefer as their Grand Prize, cash payout or two (2) bikes, within 72 hours of being declared the Winner and they may not change their mind once they have stated their preference to Station.  Winner is responsible for all taxes associated with prize receipt and/or use.  Odds of winning the Grand Prize depend on the number of eligible entries received by Station during the Contest Period.  Station reserves the right to substitute any listed prize for one of equal or greater value for any reason.  The Grand Prize Winner must take possession of the Grand Prize within seventy-two (72) hours of being declared the Winner and verified as eligible to win, otherwise the Grand Prize will be forfeited.  At that time the Station will randomly draw a name from all those qualifiers who were in attendance at the Finale Event.    
  3. 7. Entry Conditions and Release. By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Station, which are binding and final in all matters relating to this Contest; (b) release and hold harmless Station, Cumulus Media New Holdings, Inc. and its subsidiaries, related and affiliated companies, participating sponsors, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest, and each of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Contest, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an entrant’s participation in the Contest and/or entrant’s acceptance, use, non-use or misuse of the prize. To the fullest extent permitted by law, by participating in the Contest, entrants:
  4. agree to grant the Station a non-exclusive, perpetual, worldwide license to edit, telecast, exhibit, rerun, reproduce, use, syndicate, license, print, distribute and otherwise exploit any items (including any photos, videos, audio, or written material) submitted as part of the Contest entry (the “Materials”), or any portion thereof, in any manner and in any and all formats and media now known or hereafter devised, without payment to you or any third party;
  5. acknowledge that the Station reserves the right, in its sole discretion, not to use the Materials at all; and

iii.        represent and warrant that they have the legal right, power and authority to grant to the Station the license provided for herein; own or control the complete exhibition and other rights to the Materials submitted for the purposes contemplated in this license; are either the parent (or legal guardian) of any minor featured in the Materials or have received the express consent of the parent (or legal guardian) for any such minor to appear in the Materials and to enter the minor’s likeness in the Materials in the Contest; and neither the Materials nor the exercise of the rights granted herein shall infringe upon or violate the right of privacy or right of publicity of, or constitute a libel or slander against, or violate any common law or any other right of, any person or entity.

  1. Publicity. Except where prohibited, participation in the Contest constitutes winner’s consent to use by the Station and its agent of winner’s name, likeness, photograph, voice, opinions and/or biographical information (including hometown and state) for promotional purposes in any media, worldwide, without further payment or consideration, unless otherwise prohibited by law.
  2. Taxes. All State, Local, Federal and/or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner.  All those who win a prize or prizes valued $600 or more in any given year will be issued an IRS Form 1099 to report their winnings.
  3. General Conditions. Station reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Station’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Station in its sole discretion. Station reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or acting in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Station reserves the right to seek damages from any such person to the fullest extent permitted by law. Station’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  4. Limitations of Liability. The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Station, entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use, non-use or misuse of any prize. No more than the stated number of prizes will be awarded. In event that a production, technical, programming or other error causes more than stated number of prizes as set forth in these Official Rules to be claimed, Station reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
  5. Disputes. Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate state court located in the Station’s listening area; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Station in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the state in which the Station is located, without giving effect to any choice of law or conflict of law rules (whether of the state in which the Station is located or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state in which the Station is located.
  6. Entrant’s Personal Information. Information collected from entrants is subject to Station’s Privacy Policy, which is available on the Station’s website under the “Privacy Policy” link. All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained therein, shall become the sole property of Station to be used, disposed of or destroyed in its sole discretion. Station is not responsible for any incorrect or inaccurate information entered by website users, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to Station’s website.
  7. Contest Results. A winners list may be obtained within thirty (30) days after the Contest Period expires by sending a self-addressed stamped envelope to the Station identified below.
